What Is Drug Possession in Chesapeake?

In Virginia, "possession" of a controlled substance can be categorized into two main types: 

  • Actual possession: This occurs when the substance is found on the person, such as in their pockets, hands, or clothing. It implies direct physical control over the drug.
  • Constructive possession: This is more complex and involves situations where the substance is not found directly on the person but is in a place over which they have control, such as their home, car, or personal belongings. To prove constructive possession, the prosecution must show that the individual knew about the presence of the drug and could exercise control over it.

Simple Possession

This charge applies when you are found with a small amount of a controlled substance for personal use. For example, the possession of four ounces or more of marijuana is a misdemeanor in Virginia. However, possession of other controlled substances can be a felony.
