Virginia Eligibility Requirements for Uncontested Divorce

To pursue an uncontested divorce in Virginia, both spouses must agree on all significant terms: division of marital property and debt, child custody, child support, and spousal support. But agreement alone isn’t enough. The law also imposes a mandatory separation period before a divorce can be finalized.

Virginia’s separation requirements depend on whether the couple has minor children:

No minor children: Spouses must have lived separately and apart for at least six months, with a signed separation agreement in place.
Minor children involved: The required separation period extends to at least one year of living separately and apart.

Living “separately and apart” under Virginia law generally means maintaining separate residences and conducting yourselves as no longer married. The separation agreement documents the terms both spouses have accepted and becomes a binding part of the divorce process.

On residency, at least one spouse must have been a Virginia resident for a minimum of six months before filing. For the Chesapeake Circuit Court to have jurisdiction, at least one spouse must also reside in Chesapeake. The court handles all divorce proceedings as an independent city with its own trial-level courts.
